Baxter County - 08E-103062632 - Domestic Abuse/Divorce - Client wants divorce from husband, married November, 2006.  There is a long history of domestic abuse due to his alcoholism. They were separated August 2007 due to the abuse.  Last incident of abuse occurred in February, 2008, when he pushed her down and beat her up.  Lots of previous abuse, some police reports in the past.  Client states the most severe episode was when he shot her  several years ago, narrowly missed her lung but went into her breast tissue, states she took care of the wound herself and it eventually healed but lead was found still there when she had a mammogram last year, states never reported to police as she feared for her life.  No children of the marriage.  Client states he will not contest divorce.  No joint debts or property other than '00 Dodge truck that she paid insurance and maintenance on and wants it sold and profit split.  Client also concerned about tax refund and stimulus check. Benton County - 08E-101062798 - The client is a 43 year old female who is purchasing a house with her husband.  They entered into a rent to own agreement in April 2007 with B & R Properties.  The contract is supposed to be paid in full by April 2009; the total price of the property is $86,900.  The client has been making payments of about $700/month and put $5,000 down. A neighbor has reported an environmental problem and the Health Dept. sent B&R a letter to fix the problem.  B&R says it is the client’s duty to fix the violation (something is wrong with the septic tank). The grandson has lived with the client for the past 4 months, and on and off for the past 9 months.  She states that the child is better off with her and that the parents do not take proper care of him.  He has Downs Syndrome and the natural parents don’t give him his medication, his breathing treatments, or take him for his therapy appointments. The client has been doing all of this and wants legal custody.  The natural parents are married but are separating.  The client’s son will agree to the guardianship but the natural mother probably will not. She wants to file a divorce because she found out he is a felon, as well as domestic abuse. He has choked her, pulled knives on her, and has written letters threatening to kill himself and kill her.  Client advises he will agree to the divorce.  She is not pregnant. He is having problems with a neighbor on the adjoining property behind.  The neighbor built a fence in 6/07 cutting the client off from at least one acre of his property.  The neighbor had given the client an abstract showing a 30 ft. easement and the client advised her not to build the fence or he would take legal action.  The neighbor said that it was just a piece of paper and that she would build it regardless.  An abstract company informed the client that the neighbor did have a legal easement but she could not build a fence cutting him off from his property, and sent a letter to her stating this.
